Parents, teachers, and students expect schools to be a safe place. Acts of violence disrupt the learning process, not to mention having a profoundly negative emotional impact on those affected by school violence. According to a recent report on school crime and student safety by the CDC and the Department of Education, students aged twelve through eighteen are the victims of more than 2.7 million crimes at school each year. Over the past year, fifteen percent of all high school students reported being involved in a physical altercation on school property. Just how common are crimes on school campuses?

28 percent of students in middle school and high school reported being bullied in the last six months.A significant portion of these students also admitted avoiding one or more places at school for their own safety. Nearly 20% of students in middle and high school report being threatened with a beating.

According to the Gun-Free Schools Act Report, nearly four thousand students are expelled each year for bringing a gun to school. Perhaps surprisingly, more than a third of these expulsions involve middle school students, and a tenth involve even younger students. School violence might be a stereotypically high school occurrence, but it happens at all levels of the school system, even among kids as young as seven or eight years old.

In addition to incidents involving firearms, there are also thousands of other crimes, from physical assault to threat to vandalism, happening on school campuses worldwide. Not only gun-related expulsions, but also violence in general, is actually more common in middle schools than at high schools. Students aged twelve through fourteen are more likely than older students to become victims of crime at school.

It is likely that violence, theft, and drugs will continue to be significant problems in the school system. A tenth of all high school students reported being threatened with, or injured with, a weapon in the previous year. Students in middle school or high school are more likely to be victims of theft while at school than while away for school. A quarter reported that drugs had been offered to them on school property within the past year.

The point to take away from this is that kids are not immune from violence in schools, no matter their age. This might seem like an urban high school problem, but it happens in schools of all sizes, and in all locations. A staggering 86 percent of all public schools reported one or more serious violent incidents in the 2005-2006 school year. The overall crime rate within schools is 46 reported crimes each year per 1,000 students. If you have a child at school, no matter their age, they must be prepared to deal with the possibility of such situations arising.

Your options to protect your children from violence at school are unfortunately limited. The vast majority of schools have a 'no tolerance' policy, meaning that students may not carry such devices as pepper spray or a stun gun. They can, however, bring a personal alarm to school, and this can be invaluable in alerting teachers and other adults to a violent or potentially violent confrontation.

Current issues in education range over a series of subjects, some of them quite serious and needing very immediate attention of all concerned. These issues range from an increasing trend in incidents of violence at schools, concern about maintaining good academic standards, providing value added education to evolve and develop human beings with integrated personality traits and so on. One of the most important of these is the problem of violence at school.

Violence of some type or other is an unwelcome scenario in many of our schools today. Even if we take consolation in the fact that violence is caused by only a small number amidst the large mass of student population, it is taking away the credibility of our social structure.

According to reports, 270 violent deaths have occurred at schools across the USA over the last couple of decades. Statistically, this may not be a huge number; but statistics apart, every precious life that had been lost should be considered as having an impact and value beyond the borders of statistics, which is after all good only for the record books of the authorities. Most of these 270 fatalities have resulted as a consequence shooting incidents in schools. All violent incidents and occurrences also need not result in deaths but can leave bodily scars, injuries etc as well as psychologically indelible marks on the mental framework of the children who have been affected by this malady of violence in our schools.

One of the most common types of violence in schools is a physical attack, generally without any weapons unless some one uses a sharp pencil or a divider or a compass as a weapon to cause injury to others; in addition to the common incidents of the bully attacking those who appear to be weaker than him. At elementary school levels occurrences of violent incidents may be few and far between, but at middle and high school levels they are more frequent. At high school level, violence may take undesirable formats such as fighting with a weapon, sexual attacks, serious physical attacks with or without weapons and perhaps murder too. Injuries resulting from self defense attacks, unintentional but injurious attacks may also fall in the category of violence in yet another form.

Considering that violence has come to exist, we must try to find ways and means to take away this malady from the fabric of our school culture. It is the duty of the parents, the teachers, the administrators, community leaders, the students and all others concerned to plan, prepare and implement solutions so as to eliminate the evil of violence from our schools. Punishment and/or corrective measures after the event are less effective than preplanned steps in dealing with this menace. Establishing good security systems in schools to prevent unauthorized access by strangers, preventive steps to prohibit carrying any form of weapons to schools (provide metal detectors to security staff); appointing full time watch and ward staff at schools, providing ID badges to everyone inside the school premises etc are some steps which need to be immediately taken. Soft issues such as creating an awareness of the undesirable aspects of violence, creating a god fearing nature among the growing minds and personality traits of students, the karmic influence of one's actions etc can also be cultivated among parents, students and teachers.

Frequent interactive sessions and open discussion forums between teachers, parents and students should be organized so as to note and eliminate tendencies for violence among the young populace. Lessons learnt from previous experiences, the impact of even minor incidents on health of the body and mind, character formation etc should be brought out in such open forums. Awareness creation is vital so that schools become safe and an environment for studies can be generated without being intimidated unnecessarily.

The primary reason why students attend business schools is to increase their salary potential and their marketability in the business world. With reference to the article by Tania Broughton entitled "Schools can't just nail defaulters" (Mercury 9th July 2008), based on an article by Phillipa Tucker which appeared in the July 2008 De Rebus.

Phillipa Tucker is reported as stating that her article in De Rebus was written "in the hope that just one lawyer will turn around and simply say "no" when approached by a governing body to debt-collect." Well this is one attorney who will definitely say "yes" when approached by a governing body to collect school fees, because:

(a) I feel that government schools have a legal right to collect school fees in terms of the South African Schools Act ("the Schools Act") when the fees are legally due and payable in terms of the Schools Act (Section 41); and
(b) I believe without the payment of these fees education standards in these schools will drop and irreparably damage school education in this country and consequently the future of this country.

Ms Tucker in her article rightly points out that the largest portion of the South African Government's budget, R121.1 billion in 2008, is allocated to education and has been for a number of years. This has enabled the Minister of Education to increase the number of non-fee charging schools, where parents are completely exempt from paying school fees. These non-fee charging schools are determined by various measurement standards and are primarily in previously disadvantaged areas where the needs are greatest. In this regard I applaud the Minister for her efforts to bring free education to the poor.

While I do not condone any school which operates outside of the provisions of the Schools Act, and in fact I advocate and train schools in complying with the Schools Act, one needs to take a different perspective on the whole issue of the school fees, namely the schools` perspective, the effects of non-payment of school fees and the results of too many parents qualifying for exemptions in terms of the Schools Act.

I also question whether the case of Hunt Road Secondary does set a legal precedent, as it was settled by consent and the order made by Morley AJ was just giving effect to that settlement agreement.

Unfortunately, while the South African Government is providing a large chunk of its annual budget to education and the South African Bill of Rights provides for the right to education (which requires a degree of interpretation), the practicalities of providing this prove to be extremely challenging.

Firstly, the level of education provided at these non-fee charging schools is not of the same standard as the government schools which are entitled to charge fees in terms of the Schools Act (which are primarily previous model C schools). So much so that we encounter many educators (teachers) in the non-fee charging schools who elect to rather send their own children to fee charging schools because they know the difference in the education provided and they want the better education for their children.

Secondly, the current fee paying schools only receive state funding in an amount which covers, in many cases, only 50% to 60% of the teaching staff salaries and even less than the costs of their water and lights for the year - the outstanding balance is funded by school fees paid by the parents.

A common misconception with parents is that if they apply and qualify for an exemption, then the state provides the school with payment of the exempt amount. This is not true - it is the paying parents who cross-subsidise the non-paying parents. As the exemptions are calculated based on the parent's salary in relation to the school fees, what this means is that as more parents qualify for exemptions, so the school fees paid by the paying parents have to increase to compensate for this loss of income and this results in more parents qualifying for exemptions and so the result is a spiral downward for the school's funding.

I submit that the current exemption requirements are, in fact, far too lenient on the parents if measured against the very real needs of the schools. Parents in many cases are enjoying the benefits of cellular telephones, Satellite TV, expensive brand name clothes and many other consumer luxuries at the expense of a better education for their children. Yet it is the schools who are trying to make ends meet with their budgets (they are non-profit organizations), and still provide a reasonable standard of education, that are painted as the villains by Ms Tucker in her article.

Essentially, the challenge is an ideological one, where as Winston Churchill said, "The inherent vice of capitalism is the unequal sharing of blessings; the inherent virtue of socialism is the equal sharing of miseries." Do we attempt to lift the education levels of the non-fee charging schools by trying to increase their funding without burdening their indigent parents, or do we pull down the standards of the fee charging schools by starving them of the funding they so desperately need to continue delivering a reasonable education at reasonable cost? I submit that if the current fee charging government schools are destroyed by being starved of school fees then the divide between the "haves" and the "have nots" will be even greater, with the middle income earners` children receiving poorer education and the children of the wealthy the only ones receiving a good education.
